NOTICE OF INTENTION TO CIRCULATE RECALL PETITION

 

TO THE HONORABLE City Council Member Sally Lieber: Pursuant to Section 11020, California Elections Code, the undersigned registered qualified voters of the City of Mountain View, in the State of California, hereby give notice that we are the proponents of a recall petition and that we intend to seek your recall and removal from office of City Council Member, in Mountain View, California, and to demand election of a successor in that office.

 

The grounds for the recall are as follows:

-          Flagrantly jeopardizing the non-profit status of the YWCA by handing out campaign literature during a non-profit event.  Sally Lieber compounded her misconduct by refusing to cease circulating her political fliers after being asked specifically by the YWCA representatives to do so.

-          Misrepresenting the positions of Mountain View residents to save the open space on Shoreline parcels between California Street and El Camino Real.  Surreptitiously seeking to undermine the city’s commitment to open space.

-          Violating Section 1003 of the Mountain View City Charter prohibiting political activities by City employees while on duty.  On June 11, 2001, Sally Lieber contacted the President of the Mountain View Fire Fighters Union while he was on duty to seek his endorsement for her candidacy for State Assembly.

-          Willfully creating and sustaining a climate of suspicion, fear, intimidation and embarrassment in the City of Mountain View and its employees.

-          Failing the commitments required of her office to honor the due process of law.

Statement of the proponents with the City Clerk within 7 days after this notice is filed.  It may not be more

200 words.  If an answer if filed, a copy of it must also be served personally or by certified mail within that

same 7 day period on one of the above proponents.  The answer shall have the printed name,

signature, business or residence address of the officer sought to be recalled.
